Section 33
Permanent Facilities
:(1) The contractor shall construct, operate, maintain and maintain all the facilities required in the production area in relation to petroleum work.
(2) The contractor shall have the right to acquire land under section 53 and construct, operate, repair and maintain roads, pipelines and other transportation, communication and storage facilities required for petroleum operations within Nepal outside the production area. (3) If the Government of Nepal constructs, operates, maintains and maintains any such facilities required by the contractor for petroleum work within Nepal outside the production area, the contractor shall be liable to the Government of Nepal for the expenses incurred in the operation, maintenance and maintenance of such facilities, depreciation deductions, interest and reasonable profit to the Government of Nepal in the proportion used by him. (4) Apart from the properties rented or imported for temporary use, all other properties installed for the purpose of exploration, production, purification, transportation or storage of petroleum and all permanent facilities constructed shall become the property of the Government of Nepal after completion of installation or construction work. (5) Infrastructural facilities (including roads, pipelines and all other facilities related to transportation, communication and storage) built by the contractor inside or outside the production area in Nepal are available for the use of the Government of Nepal and other persons in case of an emergency or when such facilities are not used by the contractor to their full capacity.
